A deposit of 10%, payable to Rosehill Auction Service Ltd., will be required from the successful bidder on the auction day. The balance is due on or before April 24, 2026. A real estate contract will be prepared and provided to the successful bidder for signature. The successful bidder shall not impose any conditions in respect of the purchase. The real estate will be sold as is, where is. The successful bidder should be prepared to pay their share of legal fees for their lawyer to handle their side of the transaction. The balance of the purchase price is due on the closing date as set out in the real estate contract. The final bid will be subject to the Executor’s approval. If the Executor does not accept the final bid, the deposit will be returned to the bidder, and the sale voided. If the Executor accepts the bid, the successful bidder is obligated to purchase the property at the accepted bid amount, and if the successful bidder fails to do so, the full deposit will be forfeited to the Executor as liquidated damages.
